By accessing or using the TradingView Data API ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use the Service.

We reserve the right to modify these Terms at any time. Your continued use of the Service after any such changes constitutes your acceptance of the new Terms.

2. Description of Service

The TradingView Data API provides access to real-time and historical financial market data, including but not limited to:

• Stock market data from 250+ global exchanges
• Cryptocurrency market data
• Forex and currency exchange rates
• Futures and commodities data
• Market news and analysis
• Technical analysis indicators

The Service is provided through RapidAPI platform and requires a valid API key for access.

3. Account Registration and API Keys

3.1 Account Requirements

To use the Service, you must:

• Create an account on RapidAPI platform
• Subscribe to an appropriate pricing plan
• Obtain and securely store your API key
• Provide accurate and complete registration information

3.2 API Key Security

You are responsible for:

• Maintaining the confidentiality of your API key
• All activities that occur under your API key
• Immediately notifying us of any unauthorized use
• Not sharing your API key with third parties

4. Acceptable Use

4.1 Permitted Uses

You may use the Service for:

• Personal or commercial applications
• Financial analysis and research
• Building trading platforms and tools
• Data visualization and reporting

4.2 Prohibited Uses

You agree NOT to:

• Use the Service for any illegal or unauthorized purpose
• Violate any laws in your jurisdiction
• Attempt to gain unauthorized access to the Service
• Reverse engineer, decompile, or disassemble the Service
• Resell or redistribute the data without proper authorization
• Use the Service to compete directly with TradingView
• Exceed your plan's rate limits or request quotas
• Use automated systems to scrape or harvest data beyond API limits
• Interfere with or disrupt the Service or servers

5. Rate Limits and Quotas

Your use of the Service is subject to rate limits and quotas based on your subscription plan:

• Basic Plan: 150 requests per month, 1000 requests per hour
• Pro Plan: 30,000 requests per month, 5 requests per second
• Ultra Plan: 50,000 requests per month, 5 requests per second
• Mega Plan: 200,000 requests per month, 5 requests per second

Exceeding these limits may result in temporary suspension of access. We reserve the right to modify rate limits at any time.

6. Data Accuracy and Availability

6.1 Data Accuracy

While we strive to provide accurate and timely data, we do not guarantee:

• The accuracy, completeness, or timeliness of any data
• That the Service will be error-free or uninterrupted
• That defects will be corrected

6.2 Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

• Maintenance and updates
• Technical issues
• Force majeure events

7. Intellectual Property

All content, data, and materials provided through the Service, including but not limited to:

• API endpoints and documentation
• Market data and quotes
• Technical analysis indicators
• News and financial information

are the property of TradingView or its licensors and are protected by copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.

8. Payment and Billing

8.1 Subscription Plans

Subscription fees are billed monthly through RapidAPI. Prices are subject to change with 30 days' notice.

8.2 Refunds

Refunds are handled according to RapidAPI's refund policy. We do not provide direct refunds.

8.3 Cancellation

You may cancel your subscription at any time through RapidAPI. Cancellation takes effect at the end of your current billing period.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• WARRANTIES OF MERCHANTABILITY
• FITNESS FOR A PARTICULAR PURPOSE
• NON-INFRINGEMENT
• ACCURACY OR RELIABILITY OF DATA

We do not warrant that the Service will meet your requirements or that it will be uninterrupted, timely, secure, or error-free.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, revenue, data, or business opportunities
• Damages resulting from your use or inability to use the Service
• Any trading losses or financial decisions made based on our data

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

IMPORTANT: The data provided is for informational purposes only and should not be considered as financial advice. Always consult with qualified financial advisors before making investment decisions.

11. Indemnification

You agree to indemnify, defend, and hold harmless TradingView Data API, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising out of:

• Your use of the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Any content or data you submit through the Service

12. Termination

12.1 Termination by You

You may terminate your use of the Service at any time by canceling your subscription through RapidAPI.

12.2 Termination by Us

We may suspend or terminate your access to the Service immediately, without notice, if:

• You violate these Terms
• You engage in fraudulent or illegal activities
• You fail to pay subscription fees
• We discontinue the Service

12.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• All API keys will be deactivated
• You must stop using any cached or stored data
• Provisions that by their nature should survive will remain in effect

13. Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

We collect and process data through RapidAPI in accordance with their privacy policies and applicable data protection laws.

14. Third-Party Services

The Service is provided through RapidAPI platform. Your use of RapidAPI is subject to their terms of service and privacy policy. We are not responsible for:

• RapidAPI's platform availability or performance
• RapidAPI's billing or payment processing
• Any issues arising from your relationship with RapidAPI

15. Governing Law and Disputes

15.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which TradingView Data API operates, without regard to its conflict of law provisions.

15.2 Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall be resolved through:

• Good faith negotiation
• Mediation, if negotiation fails
• Binding arbitration, if mediation fails

16. General Provisions

16.1 Entire Agreement

These Terms, together with the RapidAPI terms of service, constitute the entire agreement between you and us regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
